We call upon the Government of Canada to Repeal Section 43 of the Criminal Code of Canada.

Criminal Code of Canada, Correction of Child by Force enacted in 1892 and still a law in Canada.

S.43, Every schoolteacher, parent or person standing in the place of a parent is justified in using force by way of correction toward a pupil or child, as the case may be, who is under his care, if the force does not exceed what is reasonable under the circumstances.

Two bills have been brought forward! Let’s do this Canada!

On June 20, 2022 Senator Stan Kutcher (Nova Scotia) tabled Bill S-251 to act on the TRC's Call To Action #6 to repeal Section 43 of the Criminal Code.

Dr. Stan Kutcher is a leading psychiatrist and professor who has helped young people successfully manage major mental illnesses. His appointment to the Senate allows him to put his decades of medical, academic and policy expertise at the service of all Canadians (Senate of Canada, 2022).

CALL TO ACTION 6- Repeal s43

The Truth and Reconciliation Commission of Canada (TRC) was created through a legal settlement between Residential Schools Survivors, the Assembly of First Nations, Inuit representatives and the parties responsible for creation and operation of the schools: the federal government and the church bodies.

Over 60 countries have made violent discipline illegal. Canada is NOT one of them.

Canada’s laws are vague and enable abuse. Canadian children deserve laws that protect them from harm. Coercive control and violent discipline are never reasonable. It is time to put children’s safety first.

Children are independent rights holders.

It takes government leadership to ensure rights are enshrined in law. Canada has yet to see leadership that respects children’s rights. Canadian children are not guaranteed security and do not have equal protection under the law. Children also have rights to participate in decisions that affect them, no child would choose abuse.

It is shocking that Canadian children are not legally protected from violence. It is unacceptable that Canadian laws concerning the safety of children represent year 1892.  Public Pressure and political will are needed.
